Every UK employer has auto enrolment duties from the day their first member of staff starts work. Employees have to be assessed every pay period, eligible workers enrolled into a qualifying pension scheme, contributions calculated and paid over on time, and a declaration of compliance filed with The Pensions Regulator. Get any of it wrong and the Regulator can issue fixed and escalating penalty notices — and it does.

What Auto Enrolment Requires of Employers

Auto enrolment is not a one-off setup task. Employers must assess every worker at every pay reference period against age and earnings thresholds, enrol those who qualify, process opt-ins and opt-outs within statutory time limits, keep records for six years, and re-enrol eligible leavers roughly every three years. Each of those steps has its own deadline, and The Pensions Regulator monitors compliance through the declarations employers are required to file.

Do I have auto enrolment duties if I only employ one person?
Almost certainly, yes. Auto enrolment duties apply from the day your first member of staff starts work, regardless of how small the business is. Whether that person must actually be enrolled depends on their age and earnings, but the duties — assessing them, writing to them, and filing a declaration of compliance — apply either way. Directors with no employment contract are one of the few genuine exemptions, and we can confirm whether it applies to you.
What happens if we get auto enrolment wrong?
The Pensions Regulator issues compliance notices first, then a £400 fixed penalty, then escalating daily penalties that scale with headcount — from £50 a day for the smallest employers to £10,000 a day for the largest. Backdated contributions also have to be made good, sometimes covering both the employer's and the employee's share. Most problems we see come from missed declarations or assessment errors rather than deliberate avoidance, which is exactly what running the process inside payroll prevents.
Can employees opt out of the workplace pension?
Yes — but only after they have been enrolled, and only through the proper process. An employee who opts out within one month of enrolment gets a full refund of contributions through payroll. Employers must never encourage or induce staff to opt out; that is a breach The Pensions Regulator takes seriously. We process opt-outs and refunds within the statutory windows and keep the records to prove it.
What is re-enrolment and when does it happen?
Roughly every three years from your duties start date, you must re-assess staff who previously opted out or ceased membership and put eligible ones back into the scheme, then file a re-declaration of compliance. You have a six-month window around the anniversary to choose your re-enrolment date. It is one of the most commonly missed duties because it arrives years after the original setup — we diarise it and handle it as part of the service.
